Planning Appeals Board

APPOINTMENTS OF TWO MEMBERS OF THE PLANNING APPEALS BOARD 

Applications are invited from persons who are qualified under Section 40 (5) of the Physical Planning Act (No 55) of 2021 for appointments to the Appeals Board which is independent of the Planning Authority.

One of the three members appointed shall be designated as the Chairperson. The functions of the Appeals Board are to:

 

    (a) consider any appeal by an applicant aggrieved by the decision of the Planning Authority; 

    (b) and after considering the appeal reject the appeal and confirm the Authority’s decision; 

    (c) allow the appeal in whole or in part and vary the Authority’s decision;

    (d) set aside the Authority’s decision and make a decision in substitution for it: or

    (e) direct the Authority to reconsider its decision;

    (f) notify the appellant in writing of the Appeals Board’s decision on the appeal;

 

The Appeals Board shall observe such rules of procedure as may be prescribed.  

A person is qualified for appointment as a Member of the Appeals Board on the basis of qualification or experience in the field of land use planning and sustainable development and one member shall be the representative of the Ministry responsible for environment.

 

A person appointed as a member of the Appeals Board shall hold office for a term of three years and shall be eligible for re-appointment. 

 

The remuneration or allowance of the Members of the Appeals Board shall be such as may be prescribed.
